A settlement is a transfer of property made out of natural love and affection, or to provide for a dependant, without money changing hands. It is registered like any other conveyance, and on registration the settlee becomes the owner.
That immediacy is the point people most often misunderstand. Parents frequently execute a settlement believing it will operate 'after us'. Unless the deed expressly reserves a life interest, it does not — the child owns the property from the date of registration and can, in principle, deal with it.
The deed should state the relationship, describe the property precisely with survey numbers and boundaries, recite that it is made out of love and affection, and record delivery of possession. Vague recitals are what later litigation feeds on.
