Tax deducted at source on property transfers exists so the government captures tax on capital gains at the moment the money moves, rather than chasing sellers afterwards. The mechanism therefore attaches to the person paying — the buyer — who must withhold a small percentage of the consideration and deposit it against the seller's PAN.
That design catches people off guard because it inverts the usual instinct. You are not paying your own tax; you are collecting the seller's tax on the government's behalf. If you hand the full amount to the seller and deposit nothing, the department comes to you.
The consequences are mechanical rather than discretionary: interest on the amount that should have been deducted, further interest for late deposit, a fee for each day of delay in filing the statement, and a penalty exposure on top. None of that depends on intention, which is why 'I did not know' is a common story in these files and never a defence.
