The certificate is readable once you know what each column is for and which entries change the picture.   1. Executant is the person giving the right away; claimant is the person receiving it. Reading these two columns in order is how you follow ownership down the page.
  2. 'Nature of document' is the most important column. Sale, mortgage, settlement, release, partition and attachment each mean something different for your purchase.
  3. MODT — memorandum of deposit of title deeds — is a mortgage created by depositing the originals with a bank. It is a real charge, and it is the entry buyers most often overlook.
  4. A nil-encumbrance EC means nothing was registered in that period. It does not mean the period was long enough, or that unregistered claims do not exist.
  5. Check that the extent and survey number on each entry match the property you are buying; an EC for a neighbouring subdivision will look reassuringly clean.

An EC is a table, one row per registered transaction, in date order. The first columns identify the document — the date of execution, the date of registration and the document number, which is the reference you would quote to obtain a certified copy of the deed itself. The document number is worth noting for any entry you intend to investigate.

The two columns that carry the meaning are executant and claimant. The executant is the party parting with a right; the claimant is the party acquiring it. In a sale the seller is the executant and the buyer the claimant. In a mortgage the borrower is the executant and the bank the claimant. Reading these in sequence down the page shows you the property moving from hand to hand.

Then comes the nature of the document, the extent covered, the survey number and usually the consideration. Extent matters more than people expect: a transaction may relate to only part of a survey number, so an entry that looks alarming may concern a different portion, and an entry that looks irrelevant may cover the very piece you are buying.

02MODT: the mortgage that leaves no obvious traceMODT: வெளிப்படையான தடம் விடாத அடமானம்

When a bank lends against property, the mortgage is very often created by the borrower depositing the original title deeds with the bank. A memorandum recording that deposit — the MODT — is then registered, and it appears in the EC as an entry with the borrower as executant and the bank as claimant.

Buyers miss it for two reasons. The wording is unfamiliar, so an entry reading 'memorandum of deposit of title deeds' does not shout 'mortgage' the way the word mortgage would. And because the deeds are with the bank, the seller has an explanation ready for why he can only show photocopies of the originals.

Treat a MODT as a live charge until a registered discharge or release appears later in the certificate. If it is live, the loan must be closed and the charge released as part of the transaction, with the release registered and the originals handed over. A bank's no-objection letter is a step towards that, not a substitute for it.

Read the certificate as a narrative rather than a checklist. Each sale should show the previous claimant becoming the next executant. If A sold to B in 2003, the next sale of that land should show B as executant. Where a name appears as executant without ever having appeared as claimant, something happened outside the register — an inheritance, an unregistered arrangement, or an error — and that gap is what needs explaining.

Settlement deeds, gift deeds and partition deeds are transfers too, and they break the simple buyer-to-buyer pattern. A settlement from a father to one son tells you the other children did not receive that portion through this instrument, which raises the question of how they were dealt with. That question belongs to your advocate, but you can spot the entry yourself.

Attachments and court orders deserve particular attention. An attachment before judgment, a lis pendens notice or a decree affecting the property means litigation has touched it. The dispute may be resolved, but you need to see how, and you need to see it in registered form rather than in a seller's account of it.

A certificate returning no entries is not automatically good news. It means no instrument was registered against that survey number, in that office, during that period. Each of those three qualifications can hide something: the period may be too short, the office may be the wrong one after a jurisdictional change, or the survey number may have been renumbered.

It can also mean the land genuinely has not changed hands or been charged for decades, which is common for ancestral agricultural holdings. In that situation the absence of entries is consistent with the story — but then the title has to be established from the deed chain and succession, because the register is silent about how the current holder came to hold it.

The practical rule is to read the header before the body. Confirm the survey number, the subdivision, the office and the period stated on the certificate match what you asked for and what you are buying. A nil result against the wrong parameters is the most reassuring worthless document in the file.
